What is the GDPR?
The General Data Protection Regulation (GDPR) is a data privacy and protection regulation passed by the European Commission which regulates the processing of personal information and is enforceable as of May 25th, 2018. GDPR brings with it an array of new individual rights and regulatory requirements aimed at giving individuals more visibility into and control over how their data is used.
What changes does it make to SoundCloud?
To ensure we're compliant with the GDPR and implementing best practices for our users, we have updated our Terms of Use and Privacy Policy to explain to SoundCloud users, like you, how we use your data and provide more detail about your ability to manage the information you share with us, and the new tools we’ve created to help you do that.
To give you more control over how your data is used, we’ve implemented new account settings, including Communications, Analytics and Advertising settings. Please ensure you restart the app or refresh the browser for these to become into effect.
What can I request regarding my data under the GDPR?
Under the GDPR you can request the following:
o Right of access: your right to receive confirmation of whether a company is processing your personal data, to access your personal data, and to receive a copy of it
o Right to rectification: your right to have inaccurate or incomplete data rectified
o Right to erasure (right to be forgotten): your right to have your personal data erased under certain conditions
o Right to restrict processing: your right to restrict the processing of your personal data in certain circumstances
o Right to object to processing: your right to object to processing of your personal data under certain circumstances
o Right to data portability: your right to receive a copy of your personal data in commonly used, machine readable format and to have that data transmitted to another party where technically feasible
If you’d like to submit a request regarding your personal data under the GDPR, please file a ticket.
How can I correct my account information?
If there’s information contained in your account that is not correct, you have a few ways to update it. In your Account Settings when signed in on a computer you can update your birth month and year, gender, email address and connected applications like Facebook and Google. From your Profile Edit Settings you can also change your real name, location, display name or URL that are displayed publicly.
How do you process my data?
Our Privacy Policy explains in detail how SoundCloud processes your data and the controls available to you to manage that data. We recommend reading it and reaching out to us if you have any additional questions or feedback.
What is a Data Processing Agreement?
Under GDPR, data controllers are obligated to enter into a written “data processing agreement” with service providers (known as processors) engaged to process data on its behalf, in order to evidence that the processor will operate in compliance with GDPR. However, data processing agreements do not apply to the relationship between SoundCloud and its users, since users do not process data on behalf of SoundCloud.
I use SoundCloud's embedded players on my website. What do I need to know?
If you're using SoundCloud's embed players on your own website, you need to let your users know that you are doing so, and link to our Cookie Policy, so they can understand more: https://soundcloud.com/pages/cookies. We suggest adding this in your legal pages such as the Privacy Policy or Terms of Use. You need to do this as SoundCloud may collect usage data for analytics purposes and it is therefore your responsibility to disclose this to visitors of any site where you embed the player.
Please note you do not require a data processing agreement if using our embedded players.
You can read about making changes and opting out of Cookies from our Cookies Policy: https://soundcloud.com/pages/cookies. Please see the section from "Your Choices and Controls" onwards.
You can change any options with how SoundCloud uses (or therefore doesn't use) your information either within SoundCloud or with third parties by changing your Advertising, Analytics and Communications settings. You can also change what emails and notifications you receive from us here.
However, please read through our updated Privacy and Cookies Policies regarding what information we collect and store and why. Things such as your email address are needed to have an account with SoundCloud.
If you wish to no longer have any information on SoundCloud, you can delete your SoundCloud account by signing in on a computer and going to: http://soundcloud.com/settings/account. Once you request this deletion it will automatically be removed from public view and within a short time period SoundCloud will completely delete the account and will no longer hold any personally identifiable information about you.
